These Terms of Service ("Terms") govern your access to and use of the website, products, and services provided by Gamers Guild AZ LLC ("Gamers Guild," "we," "us," or "our"). By accessing or using our website or purchasing from us, you agree to be bound by these Terms.

1. Definitions

For purposes of these Terms, the "Site" means our website and any related online services; "Services" means all services we provide; "Products" means any goods sold by us; and "User" means any person who accesses or uses the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make purchases. Minors may use the Site only under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

3. Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to update such information as needed. We reserve the right to suspend or terminate accounts at our discretion.

4. Products and Listings

We make reasonable efforts to ensure that product listings are accurate; however, listings may contain errors or inaccuracies, availability is not guaranteed, and we may change or discontinue products at any time without notice. We do not guarantee that product images or colors will display accurately on your device.

With respect to trading card products, all single card sales are final and are not eligible for return or exchange except where required by law. Opened sealed products are non-returnable. We reserve the right to cancel or limit any order due to pricing errors on singles, and we may limit or cancel purchases to prevent market manipulation, arbitrage, or abuse of promotional or pricing systems.

5. Orders and Acceptance

All orders are subject to acceptance by us. Receipt of an order confirmation does not constitute acceptance of your order. We reserve the right to cancel or limit any order for any reason, including but not limited to pricing errors, suspected fraud, or inventory issues. We may also limit quantities per customer, household, or order.

6. Pricing and Payment

All prices are subject to change without notice. Applicable taxes and shipping charges will be calculated at checkout. By submitting payment information, you represent and warrant that you are authorized to use the designated payment method.

7. Shipping and Risk of Loss

All orders are shipped via third-party carriers. Risk of loss and title pass to you upon delivery of the order to the carrier. We are not responsible for delays caused by carriers, and you are responsible for filing claims for lost or damaged shipments unless otherwise required by law.

8. Returns and Refunds

Returns and refunds are governed by our Refund Policy. We reserve the right to deny returns that do not meet eligibility requirements and to refuse service in cases of abuse of our return policies.

9. Selling to Gamers Guild AZ LLC

We may purchase items from customers through sell orders. Submission of a sell order does not guarantee acceptance. All grading determinations are made at our sole discretion, and pricing may be adjusted based on condition. Once payment is issued, the transaction is final. Sellers are responsible for shipping items to us, and we are not liable for items lost in transit.

10. User Content

If you submit content, including reviews or messages, you grant us a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, and distribute that content in any medium. You represent that you have the necessary rights to submit such content. We reserve the right to remove content at any time.

11. Prohibited Conduct

You agree not to use the Site or Services in any unlawful manner, to violate any third-party rights, to engage in fraud or abuse, to use automated tools such as bots or scraping technologies, or to interfere with the operation or security of the Site.

12. Intellectual Property

All content on the Site, including text, graphics, logos, and images, is owned by Gamers Guild AZ LLC or its licensors and is protected by applicable intellectual property laws. 15. Limitation of Liability

To the fullest extent permitted by law, Gamers Guild AZ LLC shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability for any claim arising out of or relating to these Terms, the Site, or any Products or Services shall not exceed the greater of fifty dollars ($50) or the amount you paid to us for the applicable transaction.

16. Indemnification

You agree to indemnify, defend, and hold harmless Gamers Guild AZ LLC and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising out of or related to your use of the Site or violation of these Terms.

17. Dispute Resolution

You and Gamers Guild AZ LLC agree to first attempt to resolve any dispute informally. If a dispute cannot be resolved informally, it shall be resolved through binding arbitration on an individual basis. You waive any right to participate in class actions or jury trials. Arbitration shall be conducted in Arizona under applicable rules. You may opt out of arbitration within 30 days of first accepting these Terms by contacting us in writing.

18. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes not subject to arbitration shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona.

19. Changes to Terms

We may update these Terms from time to time. Changes will be effective upon posting, and your continued use of the Site constitutes acceptance of the updated Terms.
